1. Definitions
In these Terms and Conditions:
- "Company," "we," "our," or "us" refers to Smart Cells Pakistan, the
official agent for Smart Cells International in Pakistan.
- "Client," "you," or "your" refers to the individual or entity using our
services.
- "Services" refers to stem cell banking services including collection,
processing, testing, and storage.
- "Sample" refers to cord blood and/or cord tissue collected for stem
cell storage.
- "Storage Agreement" refers to the specific contract signed between the
client and the company for stem cell storage services.
2. Services Overview
Smart Cells Pakistan provides the following services:
- Cord blood stem cell collection, processing, and storage
- Cord tissue stem cell collection, processing, and storage
- Combined cord blood and tissue storage packages
- Collection kit provision and courier services
- 24/7 customer support and emergency assistance
Our services are provided in partnership with Smart Cells International, which operates the
storage facilities in the United Kingdom.
3. Eligibility
To use our services, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into a binding contract
- Be the parent or legal guardian of the child whose stem cells are being stored
- Provide accurate and complete information
- Have the authority to make decisions regarding the child's biological materials
4. Registration and Booking
4.1 Booking Process
To register for our services:
- Complete the online booking form or contact our office
- Provide all required personal and medical information
- Select your preferred service package
- Choose a payment plan
- Sign the Storage Agreement
4.2 Collection Kit
Upon registration and payment of the initial fee, you will receive a collection kit
containing:
- Sterile collection bag(s)
- Maternal blood collection tubes
- Instructions for collection
- Transport packaging
- Documentation forms
5. Collection Process
5.1 Responsibility
The collection of cord blood and tissue is performed by trained medical professionals at your
chosen hospital or birthing center. While we provide collection instructions and support, we
are not responsible for the actual collection procedure.
5.2 Timing
Collection must occur immediately after birth and before the placenta is delivered. It is
your responsibility to inform your healthcare provider of your intention to collect stem
cells.
5.3 Sample Quality
We cannot guarantee that every collection will yield a viable sample. Factors affecting
sample quality include:
- Volume of blood collected
- Timing of collection
- Storage conditions before transport
- Medical complications during delivery
6. Processing and Storage
6.1 Processing
All samples are processed at Smart Cells International's facility in the United Kingdom,
which operates under:
- HTA (Human Tissue Authority) licensing
- ISO 9001 certification
- AABB accreditation
- UKAS accreditation
6.2 Storage Period
Standard storage contracts are for 30 years. Upon expiration, you may renew the storage
agreement for additional periods.
6.3 Sample Release
Stored samples may be released:
- For medical treatment of the donor or compatible family members
- For approved research purposes (with your consent)
- Upon termination of the storage agreement
7. Payment Terms
7.1 Packages
Current packages and information are displayed on our website and are subject to change.
Prices at the time of
booking will be honored.
7.2 Payment Plans
We offer the following payment options:
- Full payment at booking
- Two-installment plan
- 12-month payment plan
- 24-month payment plan
7.3 Late Payments
Failure to make payments as agreed may result in:
- Suspension of services
- Additional late fees
- Termination of the storage agreement
7.4 Refunds
Refund policies are as follows:
- Before collection: Full refund minus administrative fees
- After collection but before processing: Partial refund
- After processing: No refund available
8. Client Responsibilities
As a client, you agree to:
- Provide accurate and complete information
- Inform us of any changes to your contact information
- Notify your healthcare provider of your stem cell storage plans
- Contact us immediately after delivery for sample pickup
- Make payments as agreed
- Comply with all applicable laws and regulations
9. Limitation of Liability
To the maximum extent permitted by law:
- We are not liable for any failure of the collection process
- We are not liable for samples that do not meet quality standards
- We are not liable for the medical outcome of any treatment using stored stem cells
- Our total liability shall not exceed the fees paid for the specific service in question
We are not responsible for delays or failures in performance resulting from circumstances
beyond our reasonable control, including but not limited to natural disasters, war,
terrorism, labor disputes, or government actions.
10. Intellectual Property
All content on our website, including text, graphics, logos, images, and software, is the
property of Smart Cells Pakistan or its licensors and is protected by intellectual property
laws. You may not reproduce, distribute, or create derivative works without our express
written permission.
11. Confidentiality
We maintain strict confidentiality of all client information and medical records. Information
is only disclosed:
- With your consent
- To authorized medical professionals for treatment purposes
- As required by law
- To our service providers who are bound by confidentiality obligations
12. Termination
12.1 By Client
You may terminate your storage agreement by providing written notice. Refunds will be
processed according to our refund policy.
12.2 By Company
We may terminate your agreement if you:
- Breach these terms and conditions
- Fail to make required payments
- Provide false or misleading information
12.3 Upon Termination
Upon termination, you may request:
- Transfer of the sample to another licensed facility
- Disposal of the sample in accordance with applicable regulations
- Donation for research purposes (with appropriate consent)
13. Dispute Resolution
Any disputes arising from these terms or our services shall be resolved through:
- Good faith negotiation between the parties
- Mediation if negotiation fails
- Arbitration or litigation in accordance with Pakistani law
14. Governing Law
These Terms and Conditions are governed by the laws of Pakistan. Any legal proceedings shall
be conducted in the courts of Karachi, Pakistan.
15. Changes to Terms
We reserve the right to modify these Terms and Conditions at any time. Changes will be posted
on our website with an updated date. Continued use of our services after changes constitutes
acceptance of the modified terms.
16. Severability
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the
remaining provisions shall continue in full force and effect.
